These general terms and conditions apply to all orders and sales transactions via the website www.hifis.be with regard to the products offered on the website. In this agreement, we refer to "Fixxhub BV / Hifis.be," the operator of the webshop and seller of the products, using the terms "seller," "we," "us," or "Fixxhub BV / Hifis.be," with registered office at Pastoor de Herdtstraat 7, 2580 Putte, Belgium.

In these terms and conditions, you, the customer purchasing the products, will be referred to as "you" and will mean any individual, institution, or company that accesses this website, uses it, and places orders. By placing an order, you fully and unreservedly accept these terms and conditions of sale. We reserve the right to amend these terms and conditions of sale. The current version is always available in the webshop. Any changes to these terms and conditions of sale will only apply to orders placed on or after the date of amendment.

Contractual Parties and Territory

The webshop can only be used by persons who are legally capable of placing orders and are over 18 years of age.

All Fixxhub BV / Hifis.be products are intended for users living or residing in Belgium and neighboring countries, or as indicated by product. Customers wishing to place an order for delivery in a country other than the geographic areas listed are requested to contact customer service at the following email address: info@hifis.be.

Order procedure

Once you've found the product you're looking for, you can add it to your shopping cart without obligation by clicking the "Add to Cart" button. You can view the contents of your shopping cart at any time by clicking the "Add to Cart" button. You can remove items from your shopping cart by clicking the "x" button. To actually purchase the items in your shopping cart, click the "Continue to Checkout" button. You can choose to log in with your customer number or continue as a guest without registering. Please enter your information correctly to have your package delivered. Your information is encrypted before being sent to guarantee your privacy and security. After entering your information and selecting your payment method, click the "Place Order" button to complete the checkout process. You can cancel the process at any time by closing your browser window.

Fixxhub BV / Hifis.be reserves the right to refuse an order or to impose additional conditions in the case of large orders, orders placed by minors, incomplete order procedures, or problems with previous orders.

Entering into an Agreement

Before placing your order, please read these terms and conditions carefully. We recommend that you print or download a copy for later use. By clicking the "Place order" button, you indicate that you wish to purchase the products in your shopping cart and that you agree that your purchase is subject to these terms and conditions. The seller will confirm receipt of your order by sending you an email. This confirmation email will include the details of your order, the expected shipping date, and a copy of the general terms and conditions of sale in effect at the time of your order. The seller will only send you this confirmation email if the product is available and the seller can process your payment. As soon as the seller sends you the confirmation email, a legally binding agreement is formed between you and the seller. If the product you ordered is in stock and the seller can process your payment, you should receive the confirmation email within 24 hours of placing your order. If the product is listed as available on the website, but you have not received a confirmation email 48 hours after placing the order, please contact the seller's customer service via info@hifis.beIf you have not received a confirmation email within 30 days of placing your order, you are no longer obligated to purchase the products listed in your order.

Delivery

Products will be delivered, to the extent possible, within the timeframe specified in the order confirmation. In most cases, shipment will take place within 1 to 2 business days of receipt of payment. However, this timeframe is a guideline and cannot be considered binding.

For demonstration models at significantly reduced prices, we assume delivery time is 1 to 10 business days after receipt of payment. These products are first thoroughly inspected, tested, and neatly packaged. This timeframe is a guideline only and cannot be considered binding.

If you order a product that is temporarily out of stock, you'll find an estimated delivery time in the webshop. We'll let you know when the product will be back in stock on your order confirmation.

As soon as the products to be delivered have been delivered to the specified delivery address, the risk of the products concerned passes to the buyer.

Deliveries are handled by our own employees or by a courier service. Deliveries are made to the address provided by the buyer when concluding the agreement. Incorrectly provided delivery addresses are the buyer's responsibility and may result in additional charges. Shipments are delivered on weekdays, generally between 9:00 AM and 17:00 PM, unless otherwise stated. Deliveries are not made on weekends, unless otherwise stated. Please note that you must be present to accept the delivery; otherwise, the driver will leave a message to arrange delivery at a later time. To avoid being home at the time of delivery, we recommend providing your work address as the delivery address. To ensure a smooth delivery process, we ask you to provide a telephone number when ordering. This information will only be used to contact you upon delivery and will not be used for any other purposes.

We cannot accept orders for delivery to a PO Box address. Goods will be delivered to the first doorstep. You are responsible for arranging transport inside and/or to a higher floor, unless otherwise agreed.

The costs associated with the delivery of your order can be found on your order confirmation.

In exceptional circumstances, even if you have received a confirmation email, a product you ordered may no longer be available because the seller can no longer obtain it from their own supplier. If this is not due to an error on the seller's part and is beyond their reasonable control, the seller reserves the right to cancel the agreement. In that case, the seller will notify you and indicate in the webshop that the product in question is no longer available. Your payment card will not be charged. If possible, the seller may offer you an alternative of equivalent quality and price. You are free to accept or reject this offer. The seller will always make every effort to meet the stated delivery times, but these cannot always be guaranteed. Therefore, the seller is not bound by them, except with their express consent. Different terms and conditions may apply to deliveries abroad.

Prices, Taxes and Shipping Costs

The price of the products you order through the webshop is always the price in effect at the time you place your order. The price is displayed on the screen before you place your order, as well as in the confirmation email.

All our prices are expressed in euros and include VAT and Recupel. You agree to pay all sales taxes, charges, and levies required for products in the country where they are to be delivered, to the extent the seller has not already included these on your invoice.

Our shipping costs are subject to change. You will see the exact amount during the checkout process in your shopping cart.

The products remain the property of the seller until the seller has delivered the products to you.

Payment:

We accept payments via Mollie and a traditional bank transfer. You can also pick up your order and pay in cash, by appointment. You can always buy from us with confidence, because all transactions are processed using SSL encryption, ensuring maximum security.

Right of Cancellation / Returns

If you have purchased new products for non-professional use, you have the right to cancel your order without giving reasons within 8 weeks (56 calendar days) of ordering the products. This excludes products on promotion, "nice deals," demonstration models at reduced prices, used products, etc. These exceptions are subject to the statutory 14-day period.

The products must be returned to us in their original, undamaged packaging and with all accompanying documents and accessories. If the product is not returned in its original, undamaged packaging, or if any accessories are missing, we cannot fully refund your purchase. The product itself must also be free of damage, odors, stains, or any other negative impacts after receipt. 

The seller will credit your account within 14 days of receiving the products. All refunds, except for shipping and return costs, will be processed in the same way as the original payment method. Therefore, the direct costs of returning the product are the buyer's responsibility.

If you wish to return a product, please always first contact the customer service of Fixxhub BV / Hifis.be (info@hifis.beAlways do this using the model withdrawal form, which you can find alongside. We will provide you with the address to which the goods must be returned. We reserve the right to refuse returns for which we have not been notified beforehand.

You can also cancel your order before it is delivered. Have you changed your mind? Let us know as soon as possible. If the order hasn't shipped yet, we'll refund the full amount. If the order has already been delivered and it's an international shipment, the shipping costs will not be refunded. We don't charge shipping costs for Belgium.

Fixxhub BV / Hifis.be reserves the right to refuse returns in the following cases:

  • Regarding custom-made items, if we have placed an item specifically for you with the supplier, it cannot be returned or exchanged.
  • Used in-ear, on-ear, and over-ear headphones cannot be returned or exchanged if they have been used. (Hygiene!)

Complaints

Our internal complaints department can be reached via info@hifis.be, or by phone on +3215636572 between 10am and 17pm on weekdays.

If we cannot reach an agreement, you as a consumer can contact SafeShopsSafeShops mediates between the consumer and the seller if the complaint appears justified at first glance. You can reach them via complaint form or in writing: Kapelsesteenweg 195/1, 2180 Ekeren, Belgium.

Guarantee

Complaints and any visible damage and/or qualitative deficiencies when purchasing an item must be reported to Fixxhub BV / Hifis.be within 2 months of delivery (info@hifis.be), otherwise, you will lose all rights. Therefore, please check the products thoroughly upon delivery. If your complaint is justified and you have followed the procedure carefully, the seller will credit your account (including return shipping costs to your chosen carrier) or ship a replacement within 30 days of receiving the returned products. Refunds will be processed in the same way as the initial payment method.

We apply the statutory minimum warranty period of two years to the delivery of goods if the product does not conform to the order placed. This means that in the event of defects or malfunctions of the goods, free repair or replacement is possible up to two years after delivery. To the extent possible and reasonable, you have the choice between repair or replacement. Only if the repair or replacement is excessive, impossible, or cannot be carried out within a reasonable timeframe are you entitled to a price reduction or termination of the sales agreement. If the defect or malfunction manifests within six months of delivery, it is deemed to have existed before delivery, unless we can prove otherwise. After six months, you will be responsible for proving that the defect was already present at the time of delivery.

Fixxhub BV / Hifis.be makes every effort to ensure that the information provided is complete, correct, accurate, and up-to-date. Despite these efforts, inaccuracies may occur. If the information provided contains inaccuracies or if certain information on or through the site is unavailable, we will correct this as quickly as possible.

Fixxhub BV / Hifis.be cannot, however, be held liable for direct or indirect damage arising from the use of the information on this webshop.

To the extent permitted by law governing these terms and conditions, the seller will not be liable for any commercial losses incurred by the buyer (including loss of profits, revenue, contracts, estimated savings, data, goodwill or excess expenditure) or any other indirect or consequential loss, even if such losses were reasonably foreseeable to both you and the seller at the time you started using the webshop or at the time a contract for the sale of products was formed between you and the seller.

The seller cannot be held liable for circumstances beyond its control, such as strikes, fire, disruptions to communication systems, or the failure (on time) to deliver products by its suppliers or third parties.

In all cases, the seller's liability cannot exceed the amount you paid for the product or service for which a claim is being made.

Privacy

When you place an online order, we need your information. By entering this information (name, first name, email address, address, phone number, etc.) via the website, you give us permission to use it. We use it to process the administrative side of your order, but also for delivery, invoicing, marketing, and promotional campaigns or promotions. Naturally, we keep this information private and store it in a secure database that is not publicly accessible. Your information will never be shared with third parties. As a buyer, you always have the right to request your information or have it modified. In this way, Fixxhub BV / Hifis.be respects the Belgian law of 30 July 2018 regarding the protection of privacy in the processing of personal data.

Divorceability

If any article of these terms and conditions is declared null and void, such nullity will not affect the validity of the remaining articles.

Copyright

The content of the webshop is protected by copyright, trademarks, and other intellectual property rights. Individual pages or sections may be downloaded or printed, provided that copyright notices, trademarks, or other legally protected notices are not removed. In all cases, all ownership rights regarding the content and materials featured in the webshop remain with the seller or their respective suppliers (as applicable). The webshop may not be reproduced, transmitted in whole or in part via electronic or conventional methods, modified, linked to, or used for public or commercial purposes without the prior written consent of Fixxhub BV / Hifis.be.

Applicable law

These general terms and conditions and the agreements drawn up based on them are governed by Belgian law. Only the courts for the Putte region (2580) (in Belgium) have jurisdiction in this matter.
