These general terms and conditions apply to all orders and sales transactions through the website www.hifis.be regarding the products offered on the website. In this agreement we refer to "Hifis BV / Hifis.be", the operator of the webshop and seller of the products, using the terms "seller", "we", "us" or "Hifis BV / Hifis.be" with registered office at Mechelbaan 665B in 2580 Putte (Belgium).

In these terms and conditions, you, the customer purchasing the products, are referred to by the term "you" as being any individual party, institution or company who/who accesses this website, uses this website and places orders. By placing an order, you accept these terms and conditions of sale in full and without reservation. We have the right to modify the terms and conditions of sale. The current version is always available on the webshop. Any changes to the terms and conditions of sale will only apply to orders placed on or after the date of change.

Contractual Parties and Territory

The webshop can only be used by persons who are legally competent to place orders and over 18 years of age.

All Hifis BV / Hifis.be products are intended for users living or residing in Belgium and neighboring countries, or as indicated by product. Customers wishing to place an order for delivery in a country other than the geographical areas mentioned are requested to contact customer service at the following e-mail address: info@hifis.be.

Ordering Procedure

Once you have found the product you want, you can add it to your cart without any obligation by clicking on the "Add to Cart" button. You can view the contents of your cart at any time by clicking on the "Cart" button. You can remove products from your cart by clicking the "x" button. Do you wish to effectively purchase the products in your cart? Then click on the "Proceed to Checkout" button. You have the choice of logging in with your customer number or continuing as a guest without registration. Please enter your information correctly to have your package delivered. Your details will be encrypted before being sent to ensure your privacy and security. After you fill in your details and select the payment method, click the "Place Order" button to finish the ordering process. You can stop the procedure at any time by closing the browser window.

Hifis BV / Hifis.be reserves the right to refuse an order or subject it to additional conditions for large orders, orders by minors, incomplete order procedures or problems with previous orders.

Entering into an Agreement

Before placing your order, please read these terms and conditions carefully. We recommend that you print or download a copy for later use. By clicking on the "place order" button, you indicate that you wish to purchase the products in your cart and that you accept that your purchase is subject to these terms and conditions. The seller will confirm receipt of your order by sending you an email. This confirmation email will include the details of your order, the expected shipping date and a copy of the terms and conditions of sale as in effect at the time of your order. The seller will send you this confirmation email only when the product is available and when the seller can process your payment. Once the seller sends you the confirmation email, a legally binding agreement is created between you and the seller. If the product ordered is in stock and the seller can process your payment, you should receive the confirmation email within 24 hours of placing the order. If the product is listed on the website as available, but you have not received the confirmation email 48 hours after placing the order, please contact the seller's customer service department at info@hifis.be. If you have not received a confirmation email 30 days after placing the order, you are no longer obligated to purchase the products listed in your order.

Delivery

To the extent possible, the delivery of products will take place within the time communicated in the order confirmation. In most cases, shipment will take place within 1 to 2 business days after receiving payment. However, this deadline is a guideline and cannot be considered binding.

For the delivery time of demonstration models at greatly reduced prices, we assume 1 to 10 working days after receiving payment. This is because these products are first thoroughly inspected, tested and packaged again neatly. However, this deadline is a guideline and cannot be considered binding.

If you order a product that is temporarily out of stock, you will already find an estimate of the delivery time in the webshop. On the order confirmation we will inform you when the product will be back in stock.

Once the products to be delivered are delivered to the specified delivery address, the risk on respective products passes to the buyer.

Deliveries are made by our own employees or by a courier service. Deliveries are made to the address provided by the buyer during the formation of the contract. Incorrectly communicated delivery addresses are the responsibility of the buyer and may result in additional charges. Shipments are delivered on weekdays, usually between 9:00 a.m. and 5:00 p.m., if not stated otherwise. No deliveries are made on weekends unless otherwise specified. Please note that you must be present to accept the delivery, otherwise the driver will leave a message to make the delivery at a later time. To avoid not being at home at the time of delivery, we recommend that you provide, for example, your work address as the delivery address. To ensure a smooth delivery, we ask you to provide a phone number when ordering. This information will only be used to contact you upon delivery and will not be used for other purposes.

We cannot accept orders for delivery to a PO Box address. Goods are delivered to the first threshold. You are responsible for transportation inside and/or to a higher floor, if not otherwise agreed upon.

The costs associated with the delivery of your order can be found on your order confirmation.

Exceptionally, even when you have received a confirmation email, it may happen that an ordered product is no longer available because the seller can no longer obtain it from its own supplier. If this is not due to a fault of the seller and beyond his reasonable control, the seller reserves the right to withdraw from the contract. In this case, the seller will notify you and state on the webshop that the product in question is no longer available. Your payment card will also not be debited. If possible, the seller may offer you an alternative of equivalent quality and price. You are free to accept this offer or not. The seller will always make every effort to respect the delivery times indicated, but they cannot always be guaranteed. The seller is not bound by them, unless expressly agreed. Different conditions may apply to deliveries abroad.

Prices, Taxes and Shipping Costs

The price of the products you order through the webshop is always the price in effect at the time you place your order. The price is indicated on the screen before you place your order, as well as in the confirmation email.

All our prices are expressed in euros and include V.A.T. and Recupel. You agree to pay all sales or other taxes, charges and duties required for products in the country where the products are to be delivered, to the extent that the seller has not already charged them on your invoice.

Our shipping costs are subject to change, you will see the exact amount during the ordering process in your shopping cart.

The products remain the property of the seller as long as the latter has not yet delivered the products to you.

Payment:

We accept payments via Mollie and a classic bank transfer. You can also come pick up your order and pay cash, by appointment. You can always buy from us in confidence, as all transactions are carried out via ssl encryption, providing maximum security.

Right to Cancel/Return

If you have purchased new products for non-professional purposes, you have the right to cancel your order without any justification within 8 weeks (56 calendar days) of ordering the products. This with the exception of products in promotion, "nice deals", demonstration models at reduced prices, second-hand products, etc. These exceptions are subject to the statutory period of 14 days.

Products must be returned to us in their original and undamaged packaging and with all accompanying documents and accessories. If the product is not returned in its original and undamaged packaging, or if accessories are missing, we cannot fully refund your purchase. The product itself must also be free of damage, odor, stains or any form of negative addition made after receipt. 

The seller will credit your account within 14 days of receiving the products. All refunds, except for shipping and return charges, are made as the initial method of payment. Thus, the direct cost of return is the responsibility of the buyer.

If you wish to return a product, please always first contact the customer service department of Hifis BV / Hifis.be(info@hifis.be). Always do this using the "return form" that you can find here. We will provide you with the address to which the goods must be returned. We reserve the right to refuse returns of which we have not been notified first.

You can also cancel your order even before it is delivered. Have you changed your mind? Please let us know as soon as possible. If the order has not been shipped yet, we will refund you the full amount. If the order is already in delivery, and it concerns a foreign shipment, the transport costs will not be refunded. For Belgium we do not charge any delivery fee anyway.

Hifis BV / Hifis.be reserves the right to refuse returns in the following cases:

  • When it comes to customer-specific items. If we placed an item on special order for you from the supplier, it cannot be returned or exchanged.
  • When it comes to used in-ear, on-ear and over-ear headphones. These cannot be returned or exchanged if they have been used. (Hygiene!)

You can copy (copy/paste) the text below to a message for info@hifis.be and fill in / complete the necessary parameters. Use this form data only if you wish to revoke an agreement.

Complaints

Our internal complaint service can be reached at info@hifis.be, or by phone at +3215636572 between 10 a.m. and 5 p.m. on weekdays.

If we can't work it out together, as a consumer you can turn to SafeShops. SafeShops mediates between the consumer and the seller if the complaint is prima facie founded. You can reach them via the complaint form or in writing: Kapelsesteenweg 195/1, 2180 Ekeren, Belgium.

Guarantee

Complaints and any visible damage and/or qualitative shortcomings upon purchase of an item must be communicated to Hifis BV / Hifis.be(info@hifis.be) within 2 months of delivery, otherwise all rights expire. Please therefore check the products thoroughly at the time of delivery. If your complaint is valid and you have followed the procedure carefully, the seller will credit your account (including return costs by your chosen transport company) or deliver a replacement within 30 days of receiving the returned products. Refunds are made just like the initial payment method.

We apply the statutory minimum warranty period of two years for the delivery of goods if the product does not conform to the order placed. This means that in case of defects or faults in the good, a free repair or replacement is possible up to two years after delivery. As far as possible and reasonable, you have the choice between repair or replacement. Only if the repair or replacement is excessive or impossible or cannot be carried out within a reasonable period of time do you have the right to demand a price reduction or the rescission of the sales contract. If the defect or flaw manifests itself within six months of delivery, it will be deemed to have existed prior to delivery unless we can prove otherwise. After six months, you will have to prove yourself that the defect was already present at the time of delivery.

Hifis BV / Hifis.be makes great efforts to ensure that the information provided is complete, correct, accurate and up-to-date. Despite these efforts, inaccuracies may occur. If the information provided contains errors or if certain information is not available on or via the site, we will rectify this as soon as possible.

To the extent permitted by the law governing these terms and conditions, the seller shall not be liable for any commercial losses of the buyer (including loss of profits, revenues, contracts, estimated savings, data, goodwill or excess expenses) or any other indirect or consequential loss, even if such losses could have been reasonably foreseen by both you and the seller at the time you began using the web shop, or at the time an agreement came into existence between you and the seller for the sale of products.

The seller cannot be held liable for circumstances beyond its control such as strikes, fire, failure of communication systems, ... or failure of its suppliers or third parties to deliver the products (on time).

In all cases, the seller's liability cannot exceed the amount you paid for the product or service for which a claim would be made.

Privacy

When you place an online order, we need your data. By entering these data (name, first name, e-mail address, address, phone number, etc.) via the website, you give us permission to use them. We use them to take care of the administrative side of your order, but also for delivery, invoicing, marketing and advertising actions or promotions. Of course, we keep these data private and they are stored in a secure database that is not publicly accessible. Your data will never be passed on to third parties. As a buyer, you always have the right to request your data or have them modified. In this way, Hifis BV / Hifis.be respects the Belgian law of July 30, 2018 regarding the protection of privacy in the processing of personal data.

Severability

If any article of these terms and conditions is declared null and void, such nullity shall not affect the validity of the remaining articles.

Copyright

The contents of the web shop are protected by copyright, trademarks and other intellectual property rights. Individual pages or sections may be downloaded or printed, provided that copyright notices, trademarks or other legally protected notices are not removed. In all cases, all ownership rights relating to the content and materials mentioned in the webshop remain with the vendor or their respective suppliers (as applicable). The webshop may not be reproduced in whole or in part via electronic or conventional methods, modified, linked or used for public or commercial purposes without the prior written consent of Hifis BV / Hifis.be.

Applicable Law

These general conditions and the agreements drawn up on the basis thereof are governed by Belgian law. Only the courts for the Putte region (2580) (in Belgium) are competent to rule on them.
